论古罗马的体育法

    On Sports Law in Ancient Rome

    • 摘要: 通说认为,体育法是一个在近代形成的新兴法律部门。但早在古罗马时代,就产生了调整体育关系的法律实践。对罗马法原始文献的解读显示,这些法律主要表现在规定运动员的特殊法律地位和运动伤害责任认定两个方面:前者包括免税、免监护义务、免服兵役、免接待军队、可以取得骑士身份和免受社会唾弃等内容,但仅限于生来自由人可以取得以上优待;后者包括在体育比赛中发生的对比赛者或非比赛者的过失伤害免责。古今体育法的问题域具有相当程度的相似性,由此可见体育法在古罗马时代即已客观存在。

       

      Abstract: It is generally believed that sports law is a new legal department emerging in modern times.However,the practice to regulate various sports activities existed in ancient Rome.The texts in Roman law show that sports law can be found in those rules of regulating the special legal status of athletes and recognizing the responsibility from injury in sports.Accordingly the former include exempting from civil duties,tutela,military service and reception,ignominia and requiring a status of knight,all privileges of which must be based on the condition that the athletes belong to Ingenuus.The latter include exempting from the responsibility for the injury by negligence in contest.The issues of sports law in ancient times and modern ones have a huge similarity,proving that sports law existed in ancient Rome.
