    Research on Typification of the Specific Anti-ambush Marketing Legislation

    • 摘要: 埋伏营销可分为联系性埋伏营销和侵入性埋伏营销。根据各国法律中所规制的埋伏营销的范围,可将反埋伏营销特别立法分为仅保护大赛标志型立法、广泛规制联系性埋伏营销型立法以及全面规制型立法。因为,各国反埋伏营销法的规制范围不同,司法中对埋伏营销行为的处理结果也不同。立法和司法中产生这些差异的原因在于各国对反埋伏营销立法所涉及的利益进行权衡的结果不同。反埋伏营销立法会产生有限制公民言论自由、贸易自由、财产权等对基本人权的影响,这些基本人权只有以保护公共利益为由才有限制的正当性。因此,我国2022年冬奥会期间实施的反埋伏营销措施应以合理权衡各种利益关系为基础。

       

      Abstract: Ambush marketing can be divided into association ambushes and intrusion ambushes.According to the range that the law regulated in different countries,the specific anti-ambush marketing legislation can be divided into three kinds,the legislation which only protect event mark,the legislation which widely regulating association ambushes and the legislation which regulating all kinds of ambushes.Because of the disparity of the legislation,the judicial settlements to the ambush marketing are also different.The reason of the disparity is that the different countries have different results when balancing the interest involving in the ambush marketing.The specific ambush marketing legislation has the impact on fundamental human rights like the freedom of speech,the freedom of trade and the property right.The fundamental human rights can only be limited by virtue of public interest protection.Before we make the anti-ambush marketing measure which will carry out in the 2022 Winter Olympics in China,we should carefully balance the interest.
