摘要: 如何根据《世界反兴奋剂条例》的最新发展从国内政策法规层面作出积极应对,是当前中国反兴奋剂事业亟待解决的重要议题。通过文献研究发现,新修订的2021年实施版《世界反兴奋剂条例》是当今国际社会在反兴奋剂领域达成的最新共识,集中反映了世界反兴奋剂制度的革新与改良,主要表现在突出了对运动员身体健康的重视及对运动员权益的保护,完备了对兴奋剂违规行为的认定,革新了反兴奋剂斗争手段,完善了兴奋剂违规处罚机制,厘清了反兴奋剂组织内部的职责,加强了体育组织、反兴奋剂组织与政府之间的合作。新版《世界反兴奋剂条例》针对过去反兴奋剂实践工作中的重点与难点问题进行了特别修订,在许多方面加强了对运动员权利的保障,是对现行版本的全面发展与重要推进。我国相关部门应充分领悟其立法宗旨,根据其最新发展对当前我国反兴奋剂法律法规进行相应修改,完善反兴奋剂机构职能,建立体育仲裁机构,加强对外国际交流与合作,以实现与国际反兴奋剂治理体系的全面接轨。Abstract: The question of how to respond to the latest development of WADC from the perspective of domestic policies and regulations is an important issue to be solved urgently in China's anti-doping cause. Through literature method, it is found that newly revised World Anti Doping regulations to be implemented in 2021 is the latest consensus reached by the international community in the field of anti-doping and reflects the innovation and improvement of the world anti-doping system. These changes are shown in the following aspects: Emphasized the body health and the protection of the rights and interests of athletes, completed the cognizance of maturity for doping violations, revolutionized the anti-doping struggle means, perfected the mechanism of doping violations, clarified the responsibilities of the anti-doping organization, strengthened the sports organizations, anti-doping cooperation between the organization and the government. The new WADC is a comprehensive development and important promotion of the current version. It not only makes special revisions to the key and difficult issues in the past anti-doping practice,but also strengthens the protection of the rights of athletes in many aspects. The revised content should be fully affirmed. China's relevant departments should fully understand the purpose of its legislation. In order to achieve a comprehensive integration with the international anti-doping governance system, China's anti-doping laws and regulations should be amended accordingly, the antidoping agency functions should be improved, the sports arbitration agency should be established, and international exchange and cooperation with foreign countries should be strengthened as well.
