反兴奋剂治理体系下的运动员数据权利保护

    The Protection of Athlete Data Rights in the Context of an Anti-Doping Governance System

    • 摘要: 《奥林匹克2020+5议程》的颁布表明当前愈发重视数字化改革与加强运动员权利保护。反兴奋剂治理工作的开展,高度依赖相关组织对运动员个人数据的处理与运用,运动员享有知情同意权、隐私权、拒绝权、被遗忘权等数据权利。但在实践中,权利实现却因反兴奋剂治理的需要遭遇困境。无论是符合国际反兴奋剂规则的要求,还是满足我国建设体育强国的实践需求,探讨反兴奋剂治理体系下的运动员数据权利保护都具有重要意义。基于规则赋予和合同条款约定,反兴奋剂治理对运动员数据的处理具备正当性基础,但反兴奋剂治理体系下运动员数据权利的保护路径仍需完善。因此,应平衡反兴奋剂组织的权力与运动员的数据权利,明确反兴奋剂治理中运动员数据权利的性质与数据收集范围,设置完善的监管救济机制,以实现反兴奋剂治理体系下的运动员数据权利保护。

       

      Abstract: The promulgation of the Olympic Agenda 2020+5 demonstrates the increased focus on digital reform and strengthening the protection of athletes' rights. Anti-doping governance is heavily dependent on the processing and using of athletes' personal data by relevant organizations. Athletes have data rights such as the right to informed concent, the privacy right, the right to object to processing, and the right to be forgotten. However, in practice, the realization of the rights has encountered difficulties due to the needs of anti-doping governance. Whether it is to comply with the requirements of international anti-doping rules or to meet the practical needs of building a strong sports nation in China, it is of great significance to explore the protection of athletes' data rights under the anti-doping governance system. While anti-doping measures have a legitimate base for the processing of athletes' data in compliance with granting rules and contractual terms, there remains a need to enhance the path of protection of athlete data rights in the anti-doping governance system. Therefore, it is necessary to balance the power of anti-doping organizations and the data rights of athletes, to clarify the nature of athlete data rights and the scope of data collection in anti-doping governance, and to set up a perfect regulatory and relief mechanism in order to realize the protection of athletes' data rights under the anti-doping governance system.
