    人工智能体育裁判的异化风险及法律规制

    • 摘要: 近年来,人工智能全面助力体育的发展,各种人工智能体育应用顺势涌现,不断推陈出新,其中,人工智能体育裁判正是人工智能辅助人类裁判的体育应用。同时,人工智能体育裁判的适用在功能定位上存在着主客体异化风险,在事实判断上存在着过度依赖科技和算法专制的事实异化风险,在价值判断上存在着纯粹计算、随机选择和唯科学主义的价值异化风险。由此,在规制理念上,应对人工智能体育裁判秉持开放包容、审慎监管的态度;在具体裁判规则中,应明确反对赋予人工智能体育裁判法律人格、限定辅助地位,坚持人类裁判主体地位,探索精细合理的责任分配方式;在制度上,探索构建体育裁判规则领域的人机协同模式,为人工智能体育裁判设定合理边界,加强数据审查与算法规制,适时推动有限人工道德体的建构。

       

      Abstract: In recent years, artificial intelligence (AI) has been playing a crucial role in the development of sports. Various AI applications in sports have emerged, constantly innovating. AI sports officiating, in particular, utilizes AI to assist human referees. However, the application of AI in sports officiating faces risks of subject-object alienation in terms of functional positioning, over-reliance on technology and algorithmic dominance in factual judgments, and pure calculation, random selection, and scientism in value judgments. Therefore, in terms of regulatory concepts, an open and inclusive attitude with prudent supervision should be adopted towards AI sports officiating. In specific officiating rules, it is necessary to clearly oppose granting legal personality to AI sports referees and limit their auxiliary role, while maintaining the subject primacy of human referees and exploring refined and reasonable ways of responsibility allocation. In terms of systems, exploring the building of a human-machine collaborative model in the field of sports officiating rules, setting reasonable boundaries for AI sports officiating, enhancing data review and algorithmic regulation, and promoting the construction of Bounded Artificial Moral Agents in due course are essential.
