Discussion on Current Interpretation of Sports in Constitution

The research of sports law can not live without the intervention of the constitution.Whether the concept of sports, the nature of the basic rights of sports and modification of sports law, can find answers from the constitutional norms.From the beginnings, the controversy about the concept of sport can be summed up as body-mind relation, and from the viewpoint of body and mind monism, combining with the sports clauses and education article in the constitution, we can clarify the concept of sports.Along this clue, through careful analysis of terms that are directly and indirectly related to sports, although we cannot directly come to the conclusion that sports is the basic rights, but from China's modern history and the reality, it is necessary to give sports as status of the basic rights.Based on it, we points out sports law system problem in the process of modification from the perspective of organization optimization.
