Research on the Principle of“Denial of Justice in Sporting Matter”——And the Choice of China’s Future Sports Arbitration System

There are some problems in application of the legal principle of non-reviewing of the field of play decisions.The author advice to adopt the term of principle of“denial of justice in sporting matter”, which makes it as 3types:field of play decision, competition result decision and technical decision.The author also advice to get rid of the terms of“arbitral”and “bad faith”instead of responsibility of the referee.This principle is expected to be written in the sport related arbitration code.China should establish its own sport arbitration system, and there should be the specified principle of“denial of justice in sporting matter”in its arbitration rules.
