Some Legal Issues in Establishing China Sports Industry Investment Fund

    • Literature review and historical research show: industrial investment funds that originated in the UK and flourished in the US played an important role in the economic development and technological innovation of the developed countries. Based on the two national conditions of huge market volume and the late-developing country, two types of industrial funds, passive government and active government, have developed rapidly in China. The investment fund of China's sports industry is a quasi policy fund, which is funded by the government, participated by social capital and operated in a market-oriented way, and aims to promote the high-quality development of China's sports industry. It has a variety of positive significance for the development of China's sports industry. The current government-guided industrial investment funds in actual operation have obvious deficiencies in marketoriented operation systems, social capital incentives and protection, external financing guarantees, and investment range guidelines. In response to the above problems, legislation should be improved to clarify the decisive role of the market in the allocation of sports resources, strengthen protection of social capital, strengthen government responsibility, and improve the external financing legal environment and investment methods of sports industry investment funds.
