Analysis of Revising the School Physical Education of Sports Law of the People’s Republic of China

In the new historical period, the revision of the Sports Law of the People's Republic of China can't be delayed. School physical education law modification should be based on overall national layout, adhere to problem-oriented, and follow fundamental rights and obligations as the main line. This study synthesizes diachronic and synchronic elements, launches the evidence-based analysis of school physical education from three aspects, and systematically forms the texts of it, aiming to make useful explorations for the final legislation. Firstly, to grasp the key contradictions and problems in the development of school physical education, and to clarify the train of thoughts and build a firm academic basis for revising the law. Secondly, based on deepening reform of China's sports and the original legal provisions of the Sports Law of the People's Republic of China, the overall framework of revising the law in school physical education should be established from multiple dimensions. Finally, it should fully absorb major policies and regulations, and use the reference in the experience of legal construction in western countries. To carry out evidence-based analysis of the legal provisions of school physical education, the law confirms the status, educational tasks and goals of school physical education, and concretizes the sports rights and obligations of various subjects by adjusting the basic sports legal relation.
