The Legal Dilemmas and Response Options of Sports Industry’s Digitalization——In the Perspective of Data Factors

The legal construction of digital sports is an important measure for developing a safe, healthy, and sustainable digital sports industry. From the perspective of data factor, this study explored the legal dilemma of the current digital transformation of the sports industry through logic analysis and literature data method. The research found that at the legislative level, the digital transformation of China's sports industry has the problems of fragmented and lagging legislation on digital sports, single legislative orientation, and vague boundaries in the scope of application of legislation; at the law enforcement level, market supervision system should be improved and internal government supervision still needs to be strengthened; at the judicial level, digital sports ownership disputes are in urgent need of judicial interpretation, and the path for judicial protection of sports data rights is not smooth; at the law compliance level, citizens' awareness of data rights is relatively weak, sports enterprises' awareness of data rights and responsibilities is contradictory, and government departments' awareness of legal administration needs to be improved. In view of this, we propose to accelerate the legislative process of digital sports, promote the reform and innovation of the institutional mechanism of digital sports regulation, enhance the level of digitization and wisdom of digital sports justice, and strengthen the awareness of the rights of sports data subjects from the levels of legislation, law enforcement, justice and law-abiding respectively,in order to help solve the rule of law dilemma in the digital transformation of the sports industry in China.
