On the Scope of Sports Arbitration Stipulated in the Newly Revised Sports Law

Sports arbitration is an agreed arbitration based on the voluntary choice of the parties. The parties may apply for arbitration according to the arbitration agreement, the constitution of sports organizations and the rules of sports events, etc. The newly revised Sports Law creates a new sports arbitration system. Through the legislative expression of “enumerate+exclude”, the scope of sports arbitration is clarified, which provides a legal guarantee for resolving conflicts and disputes in the field of sports. The determination of the scope of sports arbitration shall be based on the national conditions, focus on the prominent problems in the field of sports, pay attention to coordination with other dispute settlement mechanisms, and safeguard state sovereignty in accordance with the law.
