Research on Anti-Doping Legal and Normative System——From the Perspective of the Revision of the “Sports Law” of People Republic

Through literature and other research methods, this paper expounds the gradual formation trend of national anti-doping legal system under the framework of global sports law, and briefly summarizes and compares the anti-doping legal system of Britain,the United States, France, Germany, Japan and other countries. Under this background, through the promulgation of the Law of the People's Republic of China on Sports(hereinafter referred to as “Sports Law”) and comprehensive revision, China has set up a special chapter on “anti-doping” in the new “Sports Law”; formulated anti-doping criminal judicial interpretation and included antidoping to criminal law amendments; formulated anti-doping regulations in accordance with international conventions and international legal documents; promulgated the anti-doping regulations and constantly revise and improve them, integrated a series of departmental rules and normative documents such as the anti-doping rules, and gradually formed a relatively perfect legal system for anti-doping. The establishment of the special chapter on “anti-doping” in the newly revised Sports Law not only embodies the guiding principle of “zero tolerance” and “zero occurrence”, but also safeguards the sports values and ethics by legal methods. It's also the legal presentation of maintaining the sports spirit of fair sports competition. The special chapter of “anti-doping” in the newly revised Sports Law makes it clear that doping governance should take the combination of prevention and punishment as the principle, the coordination and linkage of specialized agencies and departments as the means, the integration of independent management and social supervision as the pattern, the development of science and technology as the key driving force, the coordination of domestic governance and international cooperation as the vision, and the maintenance of national sovereignty and interests as the fundamental goal.
